Before you list a Tampa home on Airbnb or Vrbo, answer one question: is the property inside the City of Tampa, in unincorporated Hillsborough County, or across the bay in Pinellas County? Each answer comes with a different rulebook. The surprise for many new owners is that both the City of Tampa and unincorporated Hillsborough County have long-standing seven-day minimum rental rules for homes in residential zoning, and Florida's 2011 preemption law protects rules that existed before June 1, 2011. Here is what applies today, from primary sources.

City of Tampa: Weekly or Longer Rentals in Residential Dwellings
The City of Tampa zoning code defines a dwelling unit as being for owner occupancy or for rental, lease or other occupancy on a weekly or longer basis. Rentals by the day are treated as transient lodging uses like hotels and bed and breakfasts. In Super Host, LLC v. City of Tampa (13th Judicial Circuit, appellate division, December 2022), the court upheld a code violation against a home zoned RS-60 near Bayshore that was rented for two nights, while sending the fine amount back for review. A later 2023 appeal (Cherokee House, LLC) reversed a violation because the city could not show an actual stay shorter than seven days. The practical takeaway: plan Tampa city homes around seven-night minimums or monthly stays.
City of Tampa: No Rental Certificate, But a Business Tax Receipt
The City of Tampa repealed its rental certificate and rental registration requirement effective May 4, 2023, but business taxes are still due for all residential rental properties inside city limits. In August 2026 the City Attorney told City Council that Tampa cannot simply opt in to the county ordinance and would need to adopt its own ordinance to run a registration program. As of October 2026, Tampa has not adopted a city short-term rental registration, and council asked legal staff for an update at its November 5, 2026 meeting.
Unincorporated Hillsborough County: Seven-Day Minimum
The Hillsborough County Land Development Code prohibits renting dwelling units for less than a seven-day minimum unless the unit is located within a Resort Dwelling Overlay District. The county states this rule pre-dates 2011, which keeps it in force under Section 509.032(7)(b) of the state's lodging law. County code enforcement has fined owners for listing homes for shorter stays.
Hillsborough County Registration (Effective January 1, 2027)
On September 2, 2026 the Board of County Commissioners adopted a short-term vacation rental registration ordinance for unincorporated Hillsborough County, effective January 1, 2027. Owners must register each unit and renew every year ($200 registration, per the county), show a DBPR license and a tourist development tax account (or proof the unit is listed only on platforms that remit the tax), name a designated responsible party available 24/7 who can reach the property within one hour, post an emergency and house rules placard, put the county registration number in every ad, and allow inspections. A no-show fee applies if an inspection appointment is missed, and each day of renting without registration is a separate violation.
Florida DBPR Vacation Rental License
Any home or condo rented more than three times a year for stays under 30 days needs a vacation rental license from the DBPR Division of Hotels and Restaurants. A single-unit license is $170 a year (including the $10 Hospitality Education Program fee) plus a $50 application fee for new licenses. Hillsborough and Pinellas are in DBPR District 3, which renews every February 1.
Tampa Tax Stack: 13.5% in Hillsborough County
Stays of six months or less in Hillsborough County carry 6% Florida state sales tax, a 1.5% Hillsborough County discretionary sales surtax, and a 6% Hillsborough County Tourist Development Tax, for 13.5% in total. The tourist development tax is due to the Hillsborough County Tax Collector by the 1st of the following month and is late after the 20th. Airbnb and Vrbo have agreements to collect and remit the county tax on their bookings; direct bookings need your own account. Pinellas County properties pay 13% (6% state, 1% surtax, 6% tourist development tax).
HOA and Condo Rental Rules
Florida law limits how associations can change rental rules after you buy, but with important exceptions. A condominium amendment that prohibits rentals or changes rental terms applies only to owners who consent and to later buyers (Section 718.110(13) of the statutes). Homeowners associations, however, may adopt rules on rentals shorter than six months, and limit rentals to three times a year, that apply to all owners (Section 720.306(1)(h)). Insurance and Flood Risk
No Florida statute requires a specific short-term rental insurance policy, but lenders, condo associations and HOAs often do, and a standard homeowners policy may exclude business use.
