We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to this page. Your continued use of our services after any modifications indicates your acceptance of the updated Terms.

Surge provides short-term rental property management, real estate brokerage, and interior design services. Our services include but are not limited to:

• Property listing creation and optimization across platforms (Airbnb, Vrbo, Booking.com)
• Dynamic pricing and revenue management
• Guest communication and support
• Turnover coordination and cleaning management
• Maintenance and repairs coordination
• Regulatory compliance and permit management
• Real estate brokerage for short-term rental investment properties
• Interior design and furnishing for vacation rental properties

The specific services provided to each property owner are defined in their individual Property Management Agreement. These Terms apply to all users of our website and general services.

Property management services are governed by a separate Property Management Agreement between Surge and the property owner. Key terms of our standard agreement include:

• Cancel anytime with 90 days written notice — no penalties or buyout fees
• 30-day written notice required for termination by either party
• Management fees as specified in the individual agreement
• Revenue disbursement schedule as specified in the individual agreement
• Property owner retains ownership and final decision-making authority

In the event of any conflict between these Terms and your Property Management Agreement, the Property Management Agreement shall control.

When using our website and services, you agree to:

• Provide accurate, current, and complete information when submitting forms or creating accounts
• Not use our website for any unlawful purpose or in violation of any applicable laws
• Not attempt to gain unauthorized access to any portion of our website or systems
• Not interfere with or disrupt the integrity or performance of our website
• Not reproduce, distribute, or create derivative works from any content on our website without prior written consent
• Comply with all applicable local, state, and federal laws regarding short-term rental operations

All content on the Surge website — including text, graphics, logos, images, data compilations, software, and the overall design — is the property of Surge Property Management or its content suppliers and is protected by United States and international copyright laws.

The Surge name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Surge Property Management. You may not use such marks without our prior written permission.

You are granted a limited, non-exclusive, non-transferable license to access and use our website for personal, non-commercial purposes. This license does not include the right to collect or use any product listings, descriptions, or pricing; make any derivative use of our website or its content; or download or copy account information for the benefit of another party.

OUR WEBSITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that our website will be uninterrupted, timely, secure, or error-free. We do not warrant that the results obtained from use of our website will be accurate or reliable. We do not guarantee any specific revenue, occupancy rates, or financial results for managed properties.

Revenue projections, market data, and financial estimates provided on our website or in property assessments are for informational purposes only and should not be relied upon as guarantees of future performance.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SURGE PROPERTY MANAGEMENT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT OF FEES PAID BY YOU TO SURGE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless Surge Property Management, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of our website or services
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable law or regulation
• Any content or information you provide to us

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Harris County, Texas.

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid, illegal, or unenforceable provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving its original intent.

These Terms, together with our Privacy Policy and any applicable Property Management Agreement, constitute the entire agreement between you and Surge regarding the use of our website and services, superseding any prior agreements between you and Surge.
