Brokerage services are provided only pursuant to a fully executed written agreement, including but not limited to listing agreements, buyer representation agreements, or other state-required brokerage contracts.
Nothing on this Site creates:
- An agency relationship
- A fiduciary duty
- A brokerage agreement
Until a written agreement is executed.
Because Surge may operate in multiple states, brokerage services in any state are subject to applicable licensing laws and written agreements in that jurisdiction.
5. Short-Term Rental Management Services
Short-term rental management services are provided solely under a signed Property Management Agreement.

Property owners remain responsible for:

6. Furnishing & Design Services
Furnishing and design services are provided pursuant to a signed Design & Furnish Agreement.
Budget estimates, furnishing projections, timelines, and staging examples shown on the Site are illustrative only.
Delivery timelines, vendor availability, material costs, and logistics may vary.
7. SMS Communications & Consent (TCPA Compliance)
By submitting your phone number through this Site, you consent to receive:

- Force majeure events
Any liability shall be limited to the amount paid directly to Surge under a written agreement within the prior three (3) months.
12. Indemnification
You agree to indemnify and hold harmless EmeDos LLC d/b/a Surge, its members, officers, employees, contractors, and affiliates from any claims, damages, or expenses arising from:
- Your use of the Site
- Your investment decisions
- Regulatory noncompliance
- Guest disputes
- Breach of these Terms
13. Mandatory Binding Arbitration
Any dispute arising out of or relating to these Terms or use of this Site shall be resolved exclusively through binding arbitration administered in Harris County, Texas.
You waive the right to:
- File a lawsuit in court (except for small claims matters)
- Participate in a class action
- Participate in a jury trial
Arbitration shall be conducted under the rules of the American Arbitration Association (AAA).
Each party shall bear its own legal fees unless otherwise determined by the arbitrator.
14. Governing Law
These Terms shall be governed by the laws of the State of Texas, without regard to conflict of law principles.
15. Modifications
Surge reserves the right to modify these Terms at any time. Continued use of the Site constitutes acceptance of updated Terms.
