Austin STR Regulations

Austin has some of the strictest short-term rental regulations in Texas. The city distinguishes between owner-occupied (Type 1) and non-owner-occupied (Type 2) STRs, with a cap on Type 2 licenses that makes compliance critical.

Type 2 licenses are capped and cannot be transferred to new owners — if you buy a property with a Type 2 license, the license does not transfer.

Type 2 License Cap

Austin has capped the number of Type 2 (non-owner-occupied) STR licenses since 2016. New Type 2 licenses are only available when existing ones expire or are revoked. This makes current Type 2 licenses extremely valuable — losing yours through non-compliance is a permanent loss.

15% Hotel Occupancy Tax

Austin STR operators must collect and remit 15% total occupancy tax — 9% city HOT and 6% state HOT. Airbnb remits the city and state portions automatically, but Vrbo and Booking.com may not handle all taxes. Operators are ultimately responsible for ensuring all taxes are properly collected and filed.

Occupancy & Noise Limits

Austin limits STR occupancy to 2 guests per bedroom plus 2 additional guests (up to a maximum based on property size).
