Houston STR Regulations
Houston implemented its first citywide short-term rental ordinance under Ord. 2025-322, effective January 1, 2026. Compliance isn't optional — and enforcement is ramping up.

All Houston short-term rentals must register through the City of Houston STR Portal. The annual fee is $275 per property, plus a one-time $75 application fee for first-time registrants. Registration must be renewed every 12 months — lapsed registrations can result in fines up to $500 per day of operation.
$1M Liability Insurance
Every STR operator must maintain at least $1,000,000 in commercial general liability insurance per occurrence. Standard homeowner's insurance does not qualify. Surge verifies your policy meets city requirements and ensures it stays current — a lapsed policy means automatic non-compliance.
24-Hour Emergency Contact
A local contact or professional call center must be available 24/7 to respond to guest or neighbor complaints within 60 minutes. The contact's name, phone number, and email must be filed with the city. Surge serves as your registered emergency contact for all properties we manage.
Hotel Occupancy Tax (HOT)
Houston STRs must collect and remit 13% total occupancy tax — 7% city HOT plus 6% state HOT. Airbnb handles the city portion automatically, but other platforms may not. State HOT must be filed quarterly with the Texas Comptroller. Failure to collect or remit HOT can result in back-taxes, penalties of up to 10%, plus interest.
Human Trafficking Training
All owners and operators must complete mandatory annual human trafficking awareness training — a Houston-specific requirement that catches many hosts off guard. Training certificates must be kept on file and presented upon request during city inspections.
Neighbor Notification
Operators must provide contact information to neighbors within 200 feet of the property. This must be done at initial registration and updated if contact information changes. Non-compliance can trigger complaints that accelerate city enforcement action.
Maximum Occupancy Limits
Houston limits STR occupancy based on the number of bedrooms and overall property size. Exceeding posted maximum occupancy is a violation that can result in fines and permit revocation. All listings must clearly display the maximum guest count.
⚠️ January 2027 Enforcement Deadline
Starting January 1, 2027, the City of Houston will notify Airbnb, Vrbo, and all booking platforms to delist any STR without a valid certificate of registration. This is not a warning — unregistered listings will be removed from platforms automatically. Properties managed by Surge are already fully registered and compliant.
